一、服务说明
1. TechLab.AI 是面向建筑、室内、景观、空间设计等领域的 AI 设计辅助平台，提供 AI 图像生成、AI 视频生成、提示词辅助、专业 AI 工具人、项目管理、提示词收藏、图片处理、高清放大、局部修改等功能。
2. 平台提供的模型、工具人、功能、价格、权益、算力消耗规则，以平台页面实时展示为准。平台可能根据业务发展、技术升级、模型供应情况对服务内容进行调整。
3. AI 生成结果具有不确定性。同一提示词、同一参考图在不同时间、不同模型或不同参数下可能生成不同结果。平台不保证生成结果一定满足您的全部预期。
4. 平台提供的 AI 生成内容仅作为设计辅助、灵感参考、方案表达工具，不构成工程设计、施工图审查、法律、财务、医疗等专业意见。
二、账户注册与安全
1. 您应当具备完全民事行为能力。未成年人使用本平台的，应当在监护人同意和指导下使用。
2. 您可以通过微信、手机号、邮箱或平台支持的其他方式注册、登录账户。
3. 您应保证注册信息真实、准确、完整，并在信息变更时及时更新。
4. 您应妥善保管账户、密码、验证码及登录凭证。通过您账户发生的操作，除平台存在过错外，视为您本人行为。
5. 未经平台书面同意，您不得出售、转让、出租、出借、共享账户或将账户用于代充、代刷、批量生成等异常用途。
6. 如平台发现账户存在异常登录、违规使用、恶意注册、批量注册、攻击系统、绕过限制等行为，有权采取提醒、限制功能、冻结账户、终止服务等措施。
三、服务费用、会员与算力
1. 平台提供免费服务和付费服务。付费服务包括但不限于会员订阅、算力包、团队版、单项功能购买等。
2. 算力是平台内部用于计量 AI 生成、高清放大、视频生成等服务消耗的虚拟资源单位，不属于法定货币，不可提现、不可转让、不可继承、不可用于平台外交易。
3. 不同模型、分辨率、功能、生成类型消耗的算力不同，具体以平台页面展示和实际结算为准。
4. 算力包购买后通常长期有效；会员每日赠送算力可能具有当日有效期或其他限制，以购买页面和会员权益说明为准。
5. 生成失败、系统错误、服务异常等情形下，平台将根据实际任务状态和平台规则处理算力返还。因用户主动停止、违规输入、内容安全拦截、违反平台规则导致的消耗或损失，按平台页面提示及规则处理。
6. 如平台提供自动续费服务并由您主动开通，平台将在开通前以显著方式提示自动续费的服务内容、扣费周期、扣费金额、取消方式等信息，并在续费前依法进行提醒。您可在服务期内通过平台提供的路径随时取消或变更自动续费。会员订阅、自动续费、退款规则、发票规则、团队版权益等，以购买页面、订单页面及平台公告为准。
7. 平台有权根据模型成本、供应商价格、运营成本、活动策略调整服务价格和算力消耗标准。已经完成支付的订单，不因后续价格调整而自动变更。
四、用户输入、上传内容与生成内容
1. 用户输入包括但不限于提示词、聊天内容、上传参考图、项目图片、设计资料、局部修改区域、视频首尾帧、反馈内容等。
2. 您应确保您上传、输入、使用的内容来源合法，不侵犯第三方著作权、商标权、肖像权、隐私权、商业秘密、个人信息权益或其他合法权益。
3. 您上传的原创内容或您依法享有权利的内容，其相关权利仍归您或原权利人所有。您授权平台在提供服务、生成处理、项目存储、故障排查、安全审核、内容风控、客户支持、依法合规所必需的范围内处理上述内容。
4. 在您遵守本协议及法律法规的前提下，您可将通过平台生成的内容用于个人学习、设计辅助、方案沟通及合法商业用途。
5. 平台不主动主张您通过平台生成内容的著作权。但生成内容是否构成受著作权法保护的作品、是否可用于特定商业场景、是否侵犯第三方权利，需由您在使用、发布、交付前自行判断并承担责任。
6. 未经您单独授权，平台不会将您上传的私有项目图片、客户资料或生成内容用于公开案例展示、广告宣传或模型训练。
7. 平台可能在去标识化、匿名化或无法识别特定个人及项目主体的前提下，将必要数据用于服务质量分析、问题排查、安全风控和产品改进。涉及模型训练或对外展示的，将以平台实际提供的授权选项或另行取得的授权为准。
五、AI生成内容标识
1. 您理解并同意，平台生成的图片、视频、文本、提示词等可能属于人工智能生成合成内容。
2. 平台将在生成结果页面、下载流程、分享页面等场景对 AI 生成属性作出提示，并根据法律法规要求逐步完善文件元数据等隐式标识能力。平台通常不会在用户下载图片的画面主体中添加影响视觉交付的水印，但法律法规另有要求或特定场景需要的除外。
3. 您不得恶意删除、篡改、隐藏、伪造平台依法添加的 AI 生成内容标识。
4. 您对外发布、传播、商用平台生成内容时，应根据法律法规和平台规则，主动保留或添加必要的 AI 生成内容提示，避免公众误认为相关内容为真实拍摄、人工创作或未经处理的事实内容。
六、用户行为规范
您不得利用平台制作、输入、生成、上传、发布、传播、存储以下内容或从事以下行为：
1. 反对宪法确定的基本原则，危害国家安全、荣誉和利益，泄露国家秘密，破坏国家统一的内容；
2. 宣扬恐怖主义、极端主义、民族仇恨、民族歧视、邪教、封建迷信、暴力、赌博、色情、低俗等违法或不良内容；
3. 侮辱、诽谤他人，侵害他人名誉权、肖像权、隐私权、个人信息权益、知识产权、商业秘密等合法权益的内容；
4. 侵犯未成年人合法权益、诱导未成年人不良行为或损害未成年人身心健康的内容；
5. 利用平台生成虚假新闻、虚假证据、虚假身份、欺诈营销、误导公众、冒充他人或机构的内容；
6. 未经授权上传他人设计作品、客户资料、商业项目图纸、版权图片、人物肖像、品牌标识等内容；
7. 通过越狱提示、对抗样本、变体字、谐音、乱码、分段诱导等方式绕过平台安全审核；
8. 删除、篡改、隐藏 AI 生成内容标识或平台权利标识；
9. 攻击、扫描、爬取、逆向、干扰平台系统、模型、接口、数据库、计费系统或安全机制；
10. 批量注册、共享账号、代充、倒卖算力、转售平台服务、搭建竞品服务或未经授权调用平台能力；
11. 其他违反法律法规、公序良俗、本协议、平台规则或损害平台、用户、第三方合法权益的行为。
如您存在上述行为，平台有权采取拒绝生成、删除内容、限制功能、冻结账户、终止服务、扣除违规所得、保存记录、向主管机关报告、追究法律责任等措施。
七、内容审核与安全风控
1. 为履行法律法规要求和维护平台安全，平台有权对用户输入、上传内容、生成结果、传播行为、账户行为进行自动或人工审核。
2. 平台可能建立违法违规内容识别、风险过滤、关键词审核、图像安全检测、异常账号识别等机制。
3. 对于疑似违法违规、侵犯权利、存在安全风险或违反平台规则的内容，平台有权拒绝生成、停止传输、删除、屏蔽、限制下载、冻结相关账户或采取其他必要措施。
4. 平台会尽力提高审核准确性，但因 AI 技术和内容识别技术的局限，审核结果可能存在误判或漏判。您可通过平台提供的联系方式进行申诉或反馈。
5. 为履行网络安全、内容安全、AI生成内容标识、投诉处理及监管配合义务，平台可能依法留存网络运行日志、安全日志、生成任务记录和投诉处理记录，保存期限按照法律法规要求执行，通常不少于六个月。
八、知识产权
1. 平台的软件、程序、技术架构、界面设计、商标、标识、工具人体系、提示词模板、产品文案、页面设计、数据库结构等相关权利，归平台或相关权利人所有。
2. 未经平台书面许可，您不得复制、修改、传播、售卖、出租、反向工程、抓取或用于开发竞争产品。
3. 您上传或输入内容造成第三方权利主张的，由您自行承担责任；因此导致平台损失的，平台有权向您追偿。
4. 如您认为平台内容、用户内容或生成内容侵犯您的合法权益，可通过本协议列明的投诉方式提交权利通知。
九、投诉、举报与侵权申诉
1. 如您发现违法违规内容、侵权内容、虚假信息、账号异常、扣费异常或其他问题，可通过平台客服、邮箱或产品内反馈入口联系我们。平台将在产品页面提供投诉、举报、侵权申诉或客服反馈入口，并依法处理用户提交的合法有效请求。
2. 权利人提交侵权投诉时，应尽量提供：权利人身份证明、权属证明、被投诉内容链接或截图、侵权事实说明、联系方式、真实性承诺等材料。
3. 平台收到有效投诉后，将依法进行核查，并根据情况采取删除、屏蔽、断开链接、限制账号、通知被投诉方申诉等措施。
4. 投诉人应保证投诉材料真实、合法、有效。因恶意投诉或虚假投诉造成损失的，应承担相应责任。
十、免责声明与责任限制
1. 平台服务按现状和现有功能提供。平台不保证服务永久不中断、无错误、无延迟、完全安全或完全满足您的需求。
2. 因 AI 模型特性，平台不保证生成内容的真实性、准确性、完整性、合法性、唯一性、稳定性、可版权性或适用于特定用途。
3. 您基于平台生成内容作出的设计决策、商业交付、施工实施、宣传发布等行为，由您自行判断并承担责任。
4. 因网络故障、设备故障、第三方服务异常、模型供应商异常、支付机构异常、云服务异常、不可抗力、政府行为、黑客攻击等非平台可合理控制原因造成的服务中断、数据延迟或损失，平台将在合理范围内协助处理，但不承担超出法律规定的责任。
5. 在法律允许的范围内，平台对您的赔偿责任以您在争议发生前十二个月内实际向平台支付的服务费用总额为上限。
十一、协议变更与终止
1. 平台可根据法律法规、监管要求、产品功能、业务模式变化修改本协议。
2. 协议更新后，平台将通过网页公告、弹窗、站内通知或其他合理方式提示。您继续使用平台服务的，视为接受更新后的协议。
3. 如您不同意更新后的协议，应停止使用平台服务，并可申请注销账户。
十二、法律适用与争议解决
1. 本协议的订立、效力、履行、解释及争议解决，适用中华人民共和国法律。
2. 因本协议或平台服务产生争议，双方应友好协商解决；协商不成的，任何一方可向重庆溯源方舟智能科技有限公司住所地有管辖权的人民法院提起诉讼。

Welcome to 方舟TechLab. Before registering, signing in, making a purchase, or using this platform, please read and understand these Terms, particularly the provisions on fees, credits, rights in generated content, user conduct, disclaimers, and limitations of liability.
By clicking to agree, registering or signing in, making a purchase, or continuing to use the platform, you acknowledge that you have read, understood, and accepted these Terms, the Privacy Policy, the AI-Generated Content Service Rules, and other rules published by the platform now or in the future.
1. Services
1. 方舟TechLab is an AI-assisted design platform for architecture, interiors, landscape, and spatial design. Features include AI image and video generation, prompt assistance, specialist AI assistants, project management, saved prompts, image processing, upscaling, and local editing.
2. Available models, assistants, features, prices, benefits, and credit usage rules are those currently displayed on the platform. We may adjust the services as our business develops, technology changes, or model availability changes.
3. AI-generated results are uncertain. The same prompt or reference image may produce different results at different times or with different models or settings. We do not guarantee that a result will meet all your expectations.
4. AI-generated content is provided for design assistance, inspiration, and visual communication. It does not constitute professional engineering design, construction drawing review, legal, financial, medical, or other professional advice.
2. Registration and Account Security
1. You must have full capacity for civil conduct. Minors must use the platform with the consent and guidance of a guardian.
2. You may register or sign in using WeChat, a phone number, an email address, or another method supported by the platform.
3. Registration information must be truthful, accurate, and complete, and you must update it when it changes.
4. Keep your account, password, verification codes, and sign-in credentials secure. Unless the platform is at fault, actions taken through your account are treated as your own.
5. Without our written consent, you may not sell, transfer, rent, lend, or share an account, or use it for unauthorized top-ups, automated activity, bulk generation, or other abnormal purposes.
6. If we detect unusual sign-ins, misuse, malicious or bulk registration, attacks, or attempts to bypass restrictions, we may issue warnings, restrict features, freeze the account, or terminate services.
3. Fees, Membership, and Credits
1. The platform offers free and paid services. Paid services may include membership subscriptions, credit packs, team plans, and individual feature purchases.
2. Credits are virtual resource units used within the platform to measure consumption of services such as AI generation, upscaling, and video generation. They are not legal currency and cannot be withdrawn, transferred, inherited, or used in transactions outside the platform.
3. Credit consumption varies by model, resolution, feature, and generation type. The amount displayed by the platform and the actual settlement apply.
4. Purchased credit packs are generally valid for the long term. Daily membership credits may expire that day or have other restrictions, as stated on the purchase page and in the membership benefits.
5. For generation failures, system errors, or service problems, credit refunds depend on the actual task status and platform rules. Consumption or losses arising from a user stopping a task, prohibited input, content safety blocking, or rule violations are handled according to the displayed rules and notices.
6. If we offer automatic renewal and you choose to enable it, we will clearly disclose the service, billing period, amount, and cancellation method before activation, and provide renewal reminders as required by law. You may cancel or change automatic renewal during the service period using the available platform controls. Subscription, renewal, refund, invoice, and team benefit rules are those shown on purchase and order pages and in platform notices.
7. We may adjust prices and credit consumption based on model costs, supplier prices, operating costs, or promotional policies. Orders already paid are not automatically changed by later price adjustments.
4. User Input, Uploads, and Generated Content
1. User input includes prompts, chat messages, reference images, project images, design materials, selected edit areas, video start and end frames, feedback, and similar materials.
2. You must ensure that content you upload, enter, or use comes from lawful sources and does not infringe another party's copyright, trademark rights, portrait rights, privacy, trade secrets, personal information rights, or other lawful rights.
3. Rights in original content you upload, or content in which you lawfully hold rights, remain with you or the original rights holder. You authorize us to process that content as necessary to provide services, generate and process results, store projects, troubleshoot problems, review safety, manage content risks, provide support, and comply with law.
4. Subject to these Terms and applicable law, you may use content generated through the platform for personal learning, design assistance, proposal communication, and lawful commercial purposes.
5. We do not independently claim copyright in content you generate through the platform. Before use, publication, or delivery, you are responsible for assessing whether the content qualifies for copyright protection, is suitable for a particular commercial use, or infringes third-party rights.
6. Without your separate authorization, we will not use your uploaded private project images, client materials, or generated content for public case studies, advertising, or model training.
7. We may use necessary data for service quality analysis, troubleshooting, security risk management, and product improvement after de-identification or anonymization, or where specific individuals and project entities cannot be identified. Model training and external display are subject to the authorization options actually provided or separate authorization obtained from you.
5. Labeling AI-Generated Content
1. You understand and agree that images, videos, text, prompts, and other platform output may constitute AI-generated or synthetic content.
2. We will indicate the AI-generated nature of content on result pages, during downloads, and on sharing pages, and progressively improve implicit labeling such as file metadata as required by law. We generally do not add watermarks within the main image area that would interfere with visual delivery, except where required by law or a particular situation.
3. You must not maliciously delete, alter, hide, or falsify AI content labels that we add in accordance with law.
4. When publishing, distributing, or commercially using generated content, preserve or add the necessary AI content notices as required by law and platform rules, so that the public does not mistake it for real photography, human-created work, or unprocessed factual material.
6. User Conduct
You must not use the platform to create, enter, generate, upload, publish, distribute, or store the following content, or engage in the following conduct:
1. Content opposing the fundamental principles of the Constitution, endangering national security, honor, or interests, disclosing state secrets, or undermining national unity;
2. Unlawful or harmful content promoting terrorism, extremism, ethnic hatred or discrimination, cults, feudal superstition, violence, gambling, pornography, or vulgarity;
3. Content insulting or defaming others, or infringing reputation, portrait rights, privacy, personal information rights, intellectual property, trade secrets, or other lawful rights;
4. Content infringing minors' rights, encouraging harmful conduct by minors, or harming their physical or mental health;
5. Generating false news, evidence, or identities, fraudulent marketing, misleading the public, or impersonating a person or organization;
6. Uploading another party's design work, client materials, commercial project drawings, copyrighted images, portraits, brand marks, or similar content without authorization;
7. Bypassing safety review through jailbreak prompts, adversarial examples, variant characters, homophones, garbled text, staged prompting, or similar techniques;
8. Deleting, altering, or hiding AI content labels or platform rights notices;
9. Attacking, scanning, scraping, reverse engineering, or interfering with platform systems, models, interfaces, databases, billing systems, or security mechanisms;
10. Bulk account registration, account sharing, unauthorized top-ups, credit resale, service resale, building competing services, or unauthorized use of platform capabilities;
11. Other conduct that violates law, public order and good morals, these Terms, or platform rules, or harms the lawful rights of the platform, its users, or third parties.
If you engage in such conduct, we may refuse generation, remove content, restrict features, freeze accounts, terminate services, recover improperly obtained benefits, preserve records, report to authorities, or pursue legal liability.
7. Content Review and Security
1. To meet legal obligations and protect the platform, we may automatically or manually review user input, uploads, generated output, distribution activity, and account activity.
2. We may implement mechanisms for detecting prohibited content, filtering risks, reviewing keywords, checking image safety, and identifying abnormal accounts.
3. For content suspected of being unlawful, infringing, unsafe, or contrary to platform rules, we may refuse generation, stop transmission, delete or block content, restrict downloads, freeze related accounts, or take other necessary measures.
4. We seek to improve review accuracy, but limitations in AI and content recognition may cause incorrect decisions or missed issues. You may appeal or provide feedback through our contact channels.
5. To meet cybersecurity, content safety, AI labeling, complaint handling, and regulatory cooperation obligations, we may retain network operation logs, security logs, generation records, and complaint records as required by law, generally for no less than six months.
8. Intellectual Property
1. Rights in platform software, programs, technical architecture, interfaces, trademarks, logos, assistant systems, prompt templates, product copy, page designs, database structures, and related materials belong to us or the relevant rights holders.
2. Without our written permission, you may not copy, modify, distribute, sell, rent, reverse engineer, scrape, or use these materials to develop competing products.
3. You are responsible for third-party claims arising from content you upload or enter. We may seek reimbursement for losses this causes us.
4. If you believe platform content, user content, or generated content infringes your lawful rights, you may submit a rights notice through the complaint channels listed in these Terms.
9. Complaints, Reports, and Infringement Appeals
1. To report unlawful content, infringement, false information, account irregularities, billing problems, or other issues, contact customer support, email us, or use in-product feedback. The platform will provide complaint, reporting, infringement appeal, or support channels and handle valid lawful requests in accordance with law.
2. Infringement complaints should, where possible, include the rights holder's identity, evidence of ownership, links or screenshots of the disputed content, an explanation of the alleged infringement, contact details, and a declaration of truthfulness.
3. On receiving a valid complaint, we will investigate as required by law and may remove or block content, disable links, restrict accounts, or notify the affected user of an opportunity to appeal.
4. Complainants must ensure their submissions are truthful, lawful, and valid, and bear responsibility for losses caused by malicious or false complaints.
10. Disclaimers and Limitations of Liability
1. Services are provided as is and with their currently available features. We do not guarantee uninterrupted, error-free, delay-free, completely secure service or that every need will be met.
2. Because of the nature of AI models, we do not guarantee that generated content is truthful, accurate, complete, lawful, unique, stable, copyrightable, or suitable for a particular purpose.
3. You are responsible for your own judgment and actions in design decisions, commercial delivery, construction implementation, promotion, or publication based on generated content.
4. For interruptions, data delays, or losses caused by network or equipment failures, third-party service or model supplier problems, payment or cloud service problems, force majeure, government action, cyberattacks, or other causes beyond our reasonable control, we will offer reasonable assistance but assume no liability beyond that required by law.
5. To the extent permitted by law, our liability to you is limited to the total service fees you actually paid us in the twelve months preceding the dispute.
11. Changes and Termination
1. We may amend these Terms in response to changes in law, regulatory requirements, product features, or business models.
2. We will notify you of updates through website announcements, pop-ups, in-platform notices, or other reasonable means. Continuing to use the services signifies acceptance of the updated Terms.
3. If you do not accept the updated Terms, stop using the services. You may request account deletion.
12. Governing Law and Disputes
1. The formation, validity, performance, interpretation, and dispute resolution of these Terms are governed by the laws of the People's Republic of China.
2. Disputes arising from these Terms or the services should first be resolved through amicable negotiation. If negotiation fails, either party may bring proceedings in the competent people's court where 重庆溯源方舟智能科技有限公司 is domiciled.
