本规则是《用户服务协议》的组成部分，适用于您使用 TechLab.AI 的 AI 图像生成、AI 视频生成、AI 工具人、提示词生成、图片处理、高清放大、局部修改、底图净化等相关功能。
一、AI生成内容说明
1. 平台生成的图片、视频、文本、提示词、分析说明等内容，可能属于人工智能生成合成内容。
2. AI 生成内容具有概率性和不确定性。平台不保证生成内容完全真实、准确、完整、唯一、稳定或适合特定用途。
3. 平台生成内容仅用于设计灵感、方案表达、视觉参考和创作辅助，不应被直接视为真实照片、工程成果、施工依据或专业审查结论。
4. 您在对外发布、商业使用、客户交付、广告宣传或工程决策前，应自行进行权利审查、事实核验和专业判断。
二、AI生成内容标识
1. 为遵守人工智能生成合成内容标识相关法律法规，平台将在生成结果页面、下载流程、分享页面等场景对 AI 生成属性作出提示，例如“AI生成内容”“AI generated by TechLab.AI”等，并根据法律法规要求逐步完善文件元数据等隐式标识能力。
2. 平台通常不会在用户下载图片的画面主体中添加影响视觉交付的水印，但法律法规另有要求或特定场景需要的除外。平台后续可能在图片、视频、文件元数据或其他技术位置添加隐式标识，用于记录 AI 生成属性、服务提供者信息、内容编号、生成时间等必要信息。
3. 您下载、导出、复制或传播 AI 生成内容时，应保留平台依法添加的必要标识。
4. 未经合法正当理由，您不得删除、篡改、隐藏、伪造 AI 生成内容标识。
5. 您对外发布或传播 AI 生成内容时，应根据内容场景主动提示公众该内容由 AI 生成或合成，避免造成误解、误认或虚假传播。
三、禁止生成和使用的内容
您不得使用平台生成、编辑、上传、传播以下内容：
1. 危害国家安全、荣誉和利益，泄露国家秘密，破坏国家统一的内容；
2. 宣扬恐怖主义、极端主义、民族仇恨、民族歧视、邪教和封建迷信的内容；
3. 淫秽色情、赌博、暴力、凶杀、恐怖、血腥、虐待、教唆犯罪等违法或不良内容；
4. 侮辱、诽谤他人，侵害名誉权、肖像权、隐私权、个人信息权益的内容；
5. 侵犯著作权、商标权、专利权、商业秘密、设计成果、客户资料等第三方权益的内容；
6. 冒充他人、伪造身份、伪造证据、伪造新闻、伪造政府或机构文件、误导公众的内容；
7. 诱导未成年人不良行为、损害未成年人身心健康的内容；
8. 未经授权生成或传播他人肖像、明星名人、品牌标识、受版权保护作品、客户项目资料；
9. 用于诈骗、钓鱼、虚假营销、非法广告、恶意竞争、侵犯商业秘密的内容；
10. 其他法律法规、监管政策、平台规则禁止的内容。
四、用户上传内容要求
1. 您应确保上传的参考图、首尾帧、项目图、设计图、客户资料、局部修改图片等内容来源合法。
2. 如上传内容涉及第三方作品、客户项目、人物肖像、商业空间、品牌标识、未公开设计方案等，您应确保已取得必要授权。
3. 您不得上传涉及国家秘密、商业秘密、敏感个人信息、未公开客户资料或其他不适合提交给 AI 服务的内容。
4. 未经用户单独授权，平台不会将用户上传的私有项目图片、客户资料或生成内容用于公开案例展示、广告宣传或模型训练。
5. 因您上传内容违法、侵权或违反保密义务导致的责任，由您自行承担；因此给平台造成损失的，平台有权向您追偿。
五、用户传播和商业使用义务
1. 您可以在遵守法律法规和平台规则的前提下，将生成内容用于个人学习、设计辅助、方案沟通、社交媒体展示及合法商业用途。
2. 您对外传播生成内容时，应自行判断是否需要取得第三方授权、是否需要标明 AI 生成、是否可能构成误导。
3. 对于涉及建筑、室内、景观、施工、材料、结构、安全等专业事项的内容，您不得将 AI 生成内容直接作为最终施工、采购、验收或法律依据。
4. 如您将生成内容用于广告宣传、商业交付、客户汇报、公开发布，应自行确保内容不侵犯他人权利、不违反广告法规和行业规范。
5. 您不得声称 AI 生成内容为真实拍摄、未经处理的事实图像或由特定设计师/机构创作，除非该表述真实且有充分依据。
六、内容审核与处理
1. 平台有权对输入内容、上传图片、生成结果和传播行为进行自动或人工审核。
2. 对违法违规、侵权、高风险或违反平台规则的内容，平台有权采取拒绝生成、停止任务、删除、屏蔽、限制下载、限制账户功能、冻结账户等措施。
3. 平台可能因内容安全、模型供应商限制、第三方服务限制或技术原因拒绝生成特定内容。
4. 审核机制可能存在误判或漏判。如您认为处理有误，可通过客服或投诉渠道反馈。
七、AI模型和第三方服务
1. 平台可能接入第三方 AI 模型服务、AI 能力中转服务、云计算服务、内容安全服务，以实现生成、处理、审核和存储功能。
2. 您使用 AI 生成功能时，提示词、参考图、生成结果、任务参数等必要数据可能会被发送至相关服务方处理。
3. 平台会在合理范围内要求相关服务方遵守安全和保密义务，并要求其仅在授权范围内处理数据，不得擅自改变处理目的、处理方式或超范围使用用户数据。但第三方服务可能受其自身技术能力、政策规则、服务稳定性影响。
4. 因第三方模型服务异常、接口失败、排队延迟、内容拒绝、网络故障等导致生成失败或延迟的，平台将按照平台规则处理算力返还或任务重试。
八、生成失败与算力处理
1. AI 生成任务可能因内容安全、模型失败、第三方服务异常、网络异常、系统错误、超时、用户主动停止等原因失败。
2. 是否返还算力，以任务实际状态、失败原因、用户操作和平台当时展示的规则为准。
3. 平台不会因模型风格不符合主观预期、生成结果不够美观、提示词理解偏差等情况当然退还算力，除非平台另有活动或规则说明。
4. 如平台确认任务未成功完成且符合返还条件，将按照系统规则自动或人工处理算力返还。
九、侵权投诉与申诉
1. 如您认为平台上的生成内容、用户内容或平台处理行为侵犯您的合法权益，可向平台提交投诉。
2. 投诉材料建议包括：权利人身份信息、权属证明、被投诉内容链接或截图、侵权事实说明、联系方式、真实性承诺。
3. 平台收到有效投诉后，将依法核查并采取必要措施。
4. 被投诉用户如认为处理有误，可提交申诉材料。平台将根据双方材料和法律法规进行处理。
5. 为履行网络安全、内容安全、AI生成内容标识、投诉处理及监管配合义务，平台可能依法留存生成任务相关日志，包括用户账号、任务时间、内容编号、提示词摘要、模型服务记录、生成结果标识、投诉处理记录等，保存期限按照法律法规要求执行，通常不少于六个月。
十、违规后果
如您违反本规则，平台有权根据情节采取以下措施：
1. 拒绝生成或中止任务；
2. 删除、屏蔽、限制传播相关内容；
3. 限制下载、分享、高清放大等功能；
4. 限制、冻结或关闭账户；
5. 扣除违规取得的权益或收益；
6. 保存相关记录并依法向主管机关报告；
7. 追究法律责任或要求赔偿平台损失。

方舟TechLab AI-Generated Content Service Rules

These Rules form part of the Terms of Service and apply to AI image and video generation, AI assistants, prompt generation, image processing, upscaling, local editing, base image cleaning, and related 方舟TechLab features.
1. About AI-Generated Content
1. Images, videos, text, prompts, analyses, and other output may constitute AI-generated or synthetic content.
2. AI output is probabilistic and uncertain. We do not guarantee that generated content is entirely truthful, accurate, complete, unique, stable, or suitable for a particular purpose.
3. Generated content is intended for design inspiration, proposal communication, visual reference, and creative assistance. It must not be treated directly as real photography, an engineering deliverable, a construction basis, or a professional review conclusion.
4. Before publishing, using content commercially, delivering it to clients, advertising, or making engineering decisions, you must independently review rights, verify facts, and exercise professional judgment.
2. AI Content Labeling
1. To comply with laws on labeling AI-generated and synthetic content, we will indicate its AI-generated nature on result pages, during downloads, and on sharing pages, for example with “AI-generated content” or “AI generated by 方舟TechLab”. We will progressively improve implicit labeling such as file metadata as required by law.
2. We generally do not add watermarks within the main area of downloaded images that would interfere with visual delivery, except where required by law or a particular situation. We may later add implicit labels to images, videos, file metadata, or other technical locations to record AI generation, service provider information, content identifiers, generation times, and other necessary information.
3. When downloading, exporting, copying, or distributing AI-generated content, preserve the necessary labels we add in accordance with law.
4. Without a lawful and legitimate reason, you must not delete, alter, hide, or falsify AI content labels.
5. When publishing or distributing AI-generated content, proactively inform the public that it was generated or synthesized by AI as appropriate to the context, to avoid misunderstanding, misidentification, or misleading dissemination.
3. Prohibited Content and Uses
You must not use the platform to generate, edit, upload, or distribute the following:
1. Content endangering national security, honor, or interests, disclosing state secrets, or undermining national unity;
2. Content promoting terrorism, extremism, ethnic hatred or discrimination, cults, or feudal superstition;
3. Unlawful or harmful content involving pornography, gambling, violence, killing, terror, gore, abuse, or incitement to crime;
4. Content insulting or defaming others, or infringing reputation, portrait rights, privacy, or personal information rights;
5. Content infringing third-party rights in copyright, trademarks, patents, trade secrets, design work, client materials, or other protected interests;
6. Impersonation, false identities, fabricated evidence or news, forged government or institutional documents, or other misleading content;
7. Content encouraging harmful conduct by minors or harming their physical or mental health;
8. Unauthorized generation or distribution of portraits, celebrity likenesses, brand marks, copyrighted works, or client project materials;
9. Content used for fraud, phishing, deceptive marketing, unlawful advertising, unfair competition, or infringement of trade secrets;
10. Other content prohibited by law, regulatory policy, or platform rules.
4. Upload Requirements
1. Ensure that uploaded reference images, start and end frames, project images, design drawings, client materials, images for local editing, and other content come from lawful sources.
2. Obtain necessary authorization for uploads involving third-party works, client projects, portraits, commercial spaces, brand marks, unpublished designs, and similar materials.
3. Do not upload state secrets, trade secrets, sensitive personal information, unpublished client materials, or other content unsuitable for submission to AI services.
4. Without separate user authorization, we will not use private project images, client materials, or generated content for public case studies, advertising, or model training.
5. You are responsible for unlawful or infringing uploads and breaches of confidentiality. We may seek reimbursement for losses these cause us.
5. Distribution and Commercial Use
1. Subject to law and platform rules, you may use generated content for personal learning, design assistance, proposal communication, social media display, and lawful commercial purposes.
2. Before distributing generated content, assess whether third-party authorization or AI disclosure is needed and whether the content could be misleading.
3. For professional matters involving architecture, interiors, landscape, construction, materials, structures, or safety, you must not use AI output directly as the final basis for construction, procurement, acceptance, or legal conclusions.
4. For advertising, commercial delivery, client presentations, or public publication, ensure that the content does not infringe others' rights or violate advertising laws or industry standards.
5. Do not claim that AI-generated content is real photography, unprocessed factual imagery, or the work of a particular designer or organization unless that claim is truthful and adequately supported.
6. Content Review and Enforcement
1. We may automatically or manually review input, uploaded images, generated results, and distribution activity.
2. For unlawful, infringing, high-risk, or rule-breaking content, we may refuse generation, stop tasks, delete or block content, restrict downloads or account features, or freeze accounts.
3. Generation may be refused for content safety reasons, model provider or third-party service restrictions, or technical reasons.
4. Review systems may make incorrect decisions or miss issues. If you believe a decision is wrong, contact support or submit a complaint.
7. AI Models and Third-Party Services
1. We may use third-party AI model services, AI intermediary services, cloud computing, and content safety services for generation, processing, review, and storage.
2. When you use AI generation, necessary data such as prompts, reference images, generated output, and task settings may be sent to the relevant providers for processing.
3. Within a reasonable scope, we require providers to comply with security and confidentiality obligations and process data only as authorized, without independently changing purposes or methods or using data beyond that scope. Third-party services may nevertheless be affected by their own technical capabilities, policies, and reliability.
4. If generation fails or is delayed because of third-party model issues, interface failures, queues, content refusals, or network failures, credits and retries will be handled according to platform rules.
8. Generation Failures and Credits
1. Generation tasks may fail because of content safety, model failure, third-party service issues, network problems, system errors, timeouts, or a user stopping a task.
2. Credit refunds depend on the actual task status, failure reason, user actions, and rules displayed at the time.
3. Dissatisfaction with a model's style, image aesthetics, or interpretation of a prompt does not automatically entitle you to a credit refund, unless a separate promotion or rule states otherwise.
4. If we confirm that a task did not complete successfully and qualifies for a refund, credits will be returned automatically or manually according to system rules.
9. Infringement Complaints and Appeals
1. If you believe generated content, user content, or a platform action infringes your lawful rights, you may submit a complaint.
2. Recommended complaint materials include the rights holder's identity, evidence of ownership, links or screenshots of the disputed content, an explanation of the infringement, contact details, and a declaration of truthfulness.
3. We will investigate valid complaints and take necessary measures in accordance with law.
4. A user who believes a complaint decision is incorrect may submit an appeal. We will consider both parties' materials and applicable law.
5. To meet cybersecurity, content safety, AI labeling, complaint handling, and regulatory cooperation obligations, we may lawfully retain generation logs including account identifiers, task times, content identifiers, prompt summaries, model service records, generated result identifiers, and complaint records. Retention follows legal requirements and is generally no less than six months.
10. Consequences of Violations
If you violate these Rules, we may take the following measures depending on the circumstances:
1. Refuse generation or stop tasks;
2. Delete, block, or restrict distribution of relevant content;
3. Restrict downloads, sharing, upscaling, or other features;
4. Restrict, freeze, or close accounts;
5. Remove improperly obtained benefits or proceeds;
6. Preserve relevant records and report to competent authorities as required by law;
7. Pursue legal liability or seek compensation for platform losses.
